1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of https://fp1laps.com, including its website content and associated services (collectively, the “Services”).
The Services are operated and provided by HB Motomaster LLC, a limited liability company (“HB Motomaster,” “we,” “us,” or “our”).
The name “FP1 Laps” is used on the website to identify the services and associated branding provided by HB Motomaster LLC. References to “FP1” or “FP1 Laps” in these Terms refer to HB Motomaster LLC and its applicable Services, and not to a separate legal entity.
By accessing or using the Services, you acknowledge that you have read and agree to these Terms and any applicable policies referenced herein. If you do not agree, you must discontinue use of the Services.
If you use the Services on behalf of a business or other organization, you represent that you are authorized to accept these Terms on its behalf.
2. Description of Services
HB Motomaster LLC provides motorcycle track-day lap-timing and performance-tracking technology through the FP1 Laps website and related systems.
Depending on the event and the features available, the Services may include:
Transponder ID-based motorcycle identification and lap data.
Automated lap recording and data collection.
Live laps times, session information, and rider rankings.
Rider display names, nicknames, and historical lap data.
Tools that allow riders to monitor their progression.
Transponder ID-related registration, identification.
Related technology, reporting, rider level assessment and progression-analysis tools.
The availability of individual features may vary by event, participating organizer, equipment configuration, technical conditions, and other operational factors.
HB Motomaster LLC reserves the right to modify, improve, suspend, or discontinue any portion of the Services, subject to applicable law and any separate written agreement governing a particular service.
Optional Use of Services. HB Motomaster LLC does not require riders to use FP1 Laps’ Services. Some track-day organizations may require their customers to use FP1 Laps’ Services for rider identification, verification, group placement, coaching, safety, or other event-related purposes. Riders are responsible for determining whether to use the Services, subject to the applicable organizer's rules and requirements. Regardless of whether a rider uses the Services, each rider remains responsible for riding safely and complying with all applicable track and event rules.
3. Rider Safety and Motorsports Risks
Motorcycle riding and participation in track-day activities involve inherent risks, including serious bodily injury, permanent disability, property damage, and death.
The Services do not control your motorcycle, riding decisions, the conduct of other riders, track conditions, or the operation of independent track-day events.
You acknowledge and agree that:
You are responsible for your riding decisions, judgment, equipment, and compliance with applicable safety requirements.
You must obey track rules, flags, passing restrictions, speed restrictions, and instructions from track personnel, event organizers, instructors, and other authorized personnel.
You must never prioritize FP1 Laps data, rankings, or your performance goals over safety.
FP1 Laps data does not constitute an instruction or recommendation to ride faster, exceed your abilities, or take additional risks.
You are responsible for determining whether your riding, equipment, and participation are appropriate under the circumstances.
You should seek qualified instruction when evaluating or attempting to improve your riding skills.
The Services do not replace professional coaching, track supervision, official safety procedures, or sound riding judgment.
HB Motomaster LLC does not guarantee that using the Services will improve your riding, prevent accidents, or make participation in motorsports safer.
Nothing in these Terms waives or excludes any right or liability that cannot lawfully be waived or excluded.
4. Data Accuracy, and Technical Limitations
The Services depend on electronic equipment, microchip transponders or labels, antennas, software, communications systems, and environmental conditions.
Although HB Motomaster LLC makes reasonable efforts to provide useful and reliable data, technical limitations may affect the accuracy, completeness, or availability of the Services.
You acknowledge that:
Laps may be missed, delayed, duplicated, or incorrectly recorded.
A record may be associated with the wrong rider or identifier.
Transponder signals may be affected by interference, obstruction, equipment configuration, motorcycle positioning, or other environmental factors.
Equipment, software, or connectivity failures may interrupt or prevent Services.
Live laps data may be delayed, incomplete, or subsequently corrected.
Historical laps data, rankings, and statistics may contain errors.
Comparisons between riders or sessions may be affected by track configuration, conditions, equipment, and other variables.
The Services are not guaranteed to be uninterrupted, error-free, or available at every event.
You agree not to rely exclusively on laps data for safety-critical decisions, emergency decisions, or other purposes where inaccurate or delayed information could cause harm.
HB Motomaster LLC may correct, modify, remove, or update records when reasonably necessary to address technical errors, duplicate entries, misidentification, inaccurate data, misuse, or other legitimate operational concerns.
5. Rider Registration and Account Information
You are responsible for providing accurate information when registering for or using the Services, subject to applicable event requirements.
You must not impersonate another person, misrepresent your identity, or submit information that infringes another person's rights.
You are responsible for maintaining the confidentiality of any credentials associated with an account you create and for activities conducted through that account, subject to applicable law.
You must notify HB Motomaster LLC if you become aware of unauthorized access to your account or information associated with it.
HB Motomaster LLC may correct, restrict, or remove registration or profile information when reasonably necessary to maintain accurate records, protect the Services, enforce these Terms, or comply with applicable law.
6. Display Names and Nicknames
The Services may allow riders to select display names or nicknames.
All display names and related profile details are subject to review and may be shortened, abbreviated, modified, hidden, or omitted at any time, without prior notice, if determined to be problematic, inappropriate, easily misinterpreted, misleading, or potentially in violation of these Terms, applicable law, or the terms of service or content policies of major public media platforms.
Display names must not contain content that is obscene, sexually explicit, inappropriately sexually suggestive, hateful, threatening, harassing, discriminatory, defamatory, impersonating, or otherwise unsuitable for public display.
HB Motomaster LLC may reject or modify display names that appear designed to circumvent these requirements through alternate spellings, symbols, spacing, abbreviations, or the use of multiple name fields.
Moderation decisions may be made without advance notice when reasonably necessary to protect riders, organizers, the public, or the integrity of the Services.
You acknowledge that display names and related information may appear in public-facing event data or other materials, depending on the features used and the applicable event settings.
You should not include sensitive or confidential personal information in a display name or any other field intended for public presentation.
7. Acceptable Use
You agree to use the Services lawfully and responsibly.
You must not:
Use the Services for unlawful, fraudulent, abusive, threatening, harassing, or deceptive purposes.
Submit false registration information or impersonate another person, rider, organizer, or business.
Manipulate, falsify, interfere with, or improperly alter laps data, rankings, or registrations.
Access accounts, systems, data, or restricted areas without authorization.
Interfere with the operation, security, availability, or integrity of the Services or associated equipment.
Copy, reproduce, redistribute, or commercially exploit protected website content, software, data, or proprietary technology without authorization.
Reverse engineer, decompile, or disassemble software or technology, except where applicable law expressly permits such activity.
Use automated tools to access or collect information from the Services in a manner that violates applicable restrictions or compromises their operation.
Upload malicious software or attempt to compromise the security of the website, systems, or equipment.
Use the Services in a manner that infringes intellectual property, privacy, publicity, or other legal rights.
Circumvent reasonable security measures or restrictions imposed on your access to the Services.
HB Motomaster LLC may investigate suspected violations and take reasonable measures to protect the Services, users, partners, and equipment.
8. Track-Day Organizers and Events
HB Motomaster LLC may provide its Services in collaboration with independent motorcycle track-day organizers, racetracks, promoters, and other partners.
Providing Services at an event does not, by itself, mean that HB Motomaster LLC organizes, sponsors, manages, supervises, or controls the event.
Unless expressly agreed otherwise in writing, the event organizer remains responsible for its own event operations, registration policies, participant eligibility, track access, safety rules, rider groups, cancellations, refunds, and instructions to participants.
You are responsible for reviewing and complying with the applicable organizer's requirements.
HB Motomaster LLC is not responsible for independent decisions or conduct of an organizer, participant, racetrack, or other third party, except to the extent responsibility cannot lawfully be excluded or limited.
HB Motomaster LLC may suspend or discontinue timing services at an event when reasonably necessary because of technical failures, safety concerns, operational issues, contractual disputes, nonpayment under an applicable agreement, or other legitimate circumstances.
9. Fees and Payments
FP1 Laps Services may be offered without charge at participating events. Availability at one event does not guarantee availability at other events.
HB Motomaster LLC may charge organizers, business customers, or other parties for equipment, subscriptions, or other contracted services.
Commercial terms, fees, deposits, payment obligations, refunds, cancellations, and equipment-return requirements may be governed by separate written agreements, invoices, or other applicable arrangements.
Where a separate written agreement conflicts with these Terms concerning a specific commercial arrangement, that agreement will control to the extent of the conflict.
Nothing in these Terms obligates HB Motomaster LLC to provide free Services at every event or to provide Services beyond those expressly agreed upon.
10. Intellectual Property and Proprietary Technology
The Services and their components, including software, website content, designs, logos, graphics, interfaces, databases, documentation, timing methods, and associated materials, are owned by HB Motomaster LLC or its applicable licensors and are protected by intellectual property laws.
The FP1 Laps name, associated branding, logos, and related marks may not be used without appropriate authorization, except as permitted by applicable law.
HB Motomaster LLC has developed and uses proprietary lap-data solution, including solution that is the subject of a U.S. patent application.
U.S. Patent Application No. 64/171,191 is identified in connection with this solution. Patent application information and any patent-pending representations are subject to the actual status and scope of the applicable filing.
Except for the limited right to access and use the Services for their intended purposes in accordance with these Terms, no ownership rights or licenses are granted to you by implication or otherwise.
You may not copy, reproduce, distribute, modify, commercially exploit, or create derivative works from protected materials or proprietary solutions without prior written authorization, except where permitted by applicable law.
You retain any rights you own in content you submit to the Services. By submitting content, you grant HB Motomaster LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, and use that content as reasonably necessary to operate, maintain, secure, and provide the Services, subject to applicable law and the Privacy Policy.
11. Personal Information and Rider Data
HB Motomaster LLC may process information associated with the Services, including registration details, names, nicknames, rider identifiers, transponder identifiers, laps data, session records, event participation, and technical information.
The collection, use, retention, disclosure, and protection of personal information are governed by applicable law and the Privacy Policy published for the Services, where applicable.
Depending on the event and the features used, rider names, display names, laps data, and rankings may be visible to other riders, event organizers, or the public.
HB Motomaster LLC may use aggregated or de-identified information for service operation, analytics, reporting, troubleshooting, and service improvement, subject to applicable law.
Personal information will be handled in accordance with applicable legal requirements and the applicable Privacy Policy.
You should review the Privacy Policy for information about the categories of personal information collected, the purposes for which information is used, applicable disclosures, retention practices, and available privacy rights.
Nothing in these Terms authorizes the use or disclosure of personal information in a manner prohibited by law.
12. Third-Party Websites and Services
The Services may contain links to third-party websites, registration platforms, payment services, social media platforms, or other external services.
HB Motomaster LLC does not control independent third-party services and is not responsible for their content, policies, security, availability, or practices, except to the extent required by applicable law.
Your use of third-party services may be subject to separate terms and privacy policies. You are responsible for reviewing those terms before using the relevant service.
A link to a third-party website does not necessarily constitute an endorsement.
13. Suspension and Termination
HB Motomaster LLC may suspend, restrict, or terminate access to all or part of the Services when reasonably necessary to:
Enforce these Terms or applicable law.
Protect the security, integrity, or operation of the Services.
Address fraud, abuse, harassment, or prohibited conduct.
Investigate or correct misuse of rider profiles, registrations, or results.
Comply with legal obligations or respond to legitimate safety concerns.
Address technical, operational, or contractual circumstances affecting the Services.
Where appropriate and practicable, notice or an opportunity to correct a violation may be provided. Advance notice is not required where impracticable, where it would create a safety or security risk, or where otherwise permitted by law.
You may stop using the Services at any time.
Suspension or termination does not eliminate payment obligations or other responsibilities that were accrued before termination under an applicable agreement.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.
HB Motomaster LLC disclaims warranties, express or implied, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
HB Motomaster LLC does not warrant that the Services will be uninterrupted, secure, error-free, compatible with every device, or free from technical defects.
HB Motomaster LLC does not guarantee any particular performance improvement, rider progression, event outcome, or commercial result.
Nothing in this section excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of Liability
To the maximum extent permitted by applicable law, HB Motomaster LLC and its members, managers, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings arising out of or relating to the Services or these Terms.
To the maximum extent permitted by applicable law, the total aggregate liability of HB Motomaster LLC arising out of or relating to the Services or these Terms will not exceed the greater of:
The total amount you paid directly to HB Motomaster LLC for the specific Services giving rise to the claim during the twelve months preceding the event giving rise to liability; or
One hundred U.S. dollars (US $100).
This limitation applies regardless of the legal theory asserted, including contract, negligence, strict liability, or another basis, to the extent permitted by law.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited. These Terms do not waive rights or remedies that applicable law prohibits a party from waiving, including applicable rights concerning gross negligence, willful misconduct, or personal injury where a limitation or waiver is prohibited.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless HB Motomaster LLC and its members, managers, officers, employees, and contractors from third-party claims, liabilities, damages, and reasonable legal expenses arising from:
Your unlawful use of the Services.
Your material violation of these Terms.
Your infringement of another person's intellectual property, privacy, or other legal rights.
Content or information you submit that unlawfully harms another person.
This obligation does not extend to a claim to the extent caused by conduct for which indemnification is prohibited by applicable law.
HB Motomaster LLC may participate in the defense of a claim for which indemnification is sought, subject to applicable law. You agree to provide reasonable cooperation in the defense of such claims.
17. Changes to These Terms
HB Motomaster LLC may update these Terms to reflect changes in the Services, business practices, legal obligations, or operational requirements.
Updated Terms will be posted on https://fp1laps.com.
Where required by law, HB Motomaster LLC will provide notice of material changes and obtain any necessary consent.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. If you do not agree, you must discontinue use of the affected Services.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising out of or relating to these Terms or the Services will be brought in a court of competent jurisdiction in California, unless applicable law provides otherwise.
You and HB Motomaster LLC submit to the jurisdiction of those courts to the extent legally permitted.
Nothing in this section prevents a party from seeking relief in another forum when required by applicable law.
19. General Provisions
Entire agreement. These Terms, together with the applicable Privacy Policy and any separate written agreement governing Services, constitute the agreement governing your use of the Services.
Severability. If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
No waiver. Failure to enforce a provision does not waive the right to enforce that provision later.
Assignment. You may not transfer your rights or obligations under these Terms without prior written consent, except where applicable law provides otherwise. HB Motomaster LLC may assign these Terms in connection with a merger, restructuring, sale of assets, or other lawful business transaction.
No third-party beneficiaries. Except where expressly stated or required by law, these Terms do not create enforceable rights for third parties.
Survival. Provisions that by their nature should continue after termination will survive, including applicable provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
Relationship between the parties. These Terms do not establish a partnership, joint venture, agency, employment, or franchise relationship between you and HB Motomaster LLC.
